When you file bankruptcy in the state of Florida, your retirement savings is exempt. That means it will be protected from creditors and you will not lose it in the bankruptcy. One of the saddest things I see is when I meet with a client and they tell me that they have liquidated their retirement account to continue to pay creditors before filing. That is a sad thing to me because they would have been able to keep that retirement plan if they had filed bankruptcy sooner.
