What if a collection agency calls me and says that my credit card debt cannot be discharged in bankruptcy? | The Golden Law Group | Helping Residents & Businesses Get Financial Stability | (813) 413-8700 | http://BrandonLawyer.com | 808 Oakfield Drive, Ste A, Brandon, Florida 33511 | 9040 Town Center Pkwy, Bradenton, Florida 34202
The bankruptcy laws were amended in October of 2005. One of the misconceptions was that you would no longer be able to discharge your credit card debt in bankruptcy. A lot of debt collectors have used that misconception to their advantage by trying to tell consumers before they file that they will not be able to discharge their credit card debt in bankruptcy. That is a lie. Bankruptcy debt is dischargeable in bankruptcy. If a creditor or a debt collector tells you that it is not dischargeable, then that is a violation of the Fair Debt Collection Practices Act. I highly recommend you speak to a qualified attorney about that.
