If you have previously filed bankruptcy and you want to file bankruptcy again, the time in which you need to wait is going to be determined by two things. One, what kind of case you filed previously, and two, what kind of case you would like to file now. For instance, if you filed a Chapter 7 case first, and you now want to file another Chapter 7 case, you need to wait 8 years between cases. If you filed a Chapter 7 case and now you want to file a Chapter 13 case, you need to wait 6 years. If you filed a Chapter 13 previously and now you want to file a Chapter 7 case, you need to wait 4 years. If you want to file another Chapter 13 case, you only need to wait 2 years before you can refile.
