Transferring assets out of your name right before filing bankruptcy is considered fraud. If you do that and you file bankruptcy, your bankruptcy trustee could suit the person that you transferred your assets to in order to bring those assets back into the estate. If you do decide to transfer assets out of your name into another’s name, then you should wait at least two years before you file bankruptcy.
