Under Florida law, your homestead is protected when you file bankruptcy. However, there are exceptions. In order to claim the Florida homestead exemption when you file bankruptcy, you have to have lived in Florida for at least two years before you file. Also, if you sell a non-exempt asset, and use that money to pay down your mortgage within 10 years of filing bankruptcy, that could jeopardize your homestead exemption when you file bankruptcy.
