G. DONALD GOLDEN: If debt collectors are calling and harassing you, we can represent you in a lawsuit against them for violating the Fair Debt Collection Practices Act.
A debt collector is never allowed to contact a third party to collect a debt. They are allowed to contact third parties to obtain location information only. If a debt collector has contacted one of your friends, family members, neighbors or employer, they have violated the statute.
Another common violation of the statute is where a debt collector will make threats against you to file a lawsuit or to garnish your wages or put a lien on your home. If either of these things have happened to you, you should call our office to schedule a free consultation.
Creditor harassment is when a debt collector treats a consumer with anything other than honesty, dignity, truthfulness and respect.

G. DONALD GOLDEN: If a debt collector violates your rights under the Fair Debt Collection Practices Act, you're entitled to statutory damages of up to $1,000, actual damages if there are any, plus your attorney's fees and costs.
Many of my bankruptcy clients are able to finance their bankruptcy case by bringing an action against a debt collector for violating their rights. If you believe that you've been the victim of creditor harassment, call our office to schedule a free consultation.
