Under the rules of Chapter 7 and Chapter 13 bankruptcy, it is often possible to keep your home and your primary automobile, depending upon a variety of factors. You are allowed to declare exemptions on an unlimited amount of equity in your home. For other property, such as your car, you are allowed to exempt up to $1,000 of equity.

Reaffirming Your Debt

But filing for bankruptcy doesn't mean you get to discharge your debts, then get to keep the house and car. An experienced attorney at The Golden Law Group will assess your financial circumstances and help you decide whether it is appropriate to 'reaffirm' your debt. That simply means that you agree to continue making timely payments to your banker for your mortgage and car loan. You have to list debt in your schedules even if you intend to reaffirm it.

Stripping Off a Second Mortgage

Many people want to remain in their homes after filing bankruptcy, but can no longer afford the mortgage payment because of so-called junior mortgages (any second or third mortgage you have added in addition to your original mortgage). By filing Chapter 13 bankruptcy, you may be able to strip off the second mortgage, to reduce your monthly obligation. Special conditions apply, so talk to an experienced attorney about finding ways to stay in your house by reducing your mortgage amount.

The bankruptcy process can be confusing, but it doesn't have to be overwhelming. The experienced attorneys at The Golden Law Group have helped many people just like you. Let us help you get the debt relief you need, and stay in your home if it is the best thing for your family.
